Agreement

By installing or using the OpenTime iOS app or visiting this website, you agree to these terms. If you do not agree, do not install the app or use the site.

License (the app)

OpenTime is distributed through the Apple App Store. Your use of the app is governed by Apple's standard Licensed Application End User License Agreement, which is incorporated here by reference. That agreement grants you a non-transferable license to use OpenTime on Apple-branded devices you own or control.

Apple's role

You acknowledge that these terms are between you and the developer (James Tannahill), not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these terms and may enforce them against you.

No warranty

The app and the website are provided as-is, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The developer does not warrant that the app will be error-free, uninterrupted, or that any bug will be corrected.

Limitation of liability

To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app or the website. The developer's total cumulative liability will not exceed the amount you paid for the app, which is zero.

Indemnification

You agree to indemnify and hold the developer harmless from any claim arising out of your misuse of the app or violation of these terms.

Changes

The developer may update these terms from time to time. The current version is always posted at this URL with the effective date above. Continued use of the app or website after a change constitutes acceptance.

Governing law

These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in New York County, New York.
